1. Who we are
The online shop at swissdesign-haag.ch is operated by Swissdesign Haag AG, Forchwaldstrasse 53, 6318 Walchwil, UID CHE-365.806.398.
Showroom: Huobstrasse 2, 6045 Meggen. Phone: +41 76 400 51 57. Email: [email protected].
We are referred to below as the "Seller" and you as the "Customer".
2. Scope
These General Terms and Conditions apply to all orders placed through the online shop or in the showroom, and to made-to-measure tables. Any terms of your own that differ from these apply only if we agree to them in writing. The version of these Terms in force when the contract is concluded shall prevail.
3. Conclusion of the contract
The presentation of the tables in the shop is an invitation to order, not a binding offer. The contract is concluded when we confirm your order by email.
Every table is one of a kind and there is only one of each. If an ordered piece has been sold in the meantime, we will inform you immediately and refund in full any payments already made.
For tables made to measure, the contract is concluded with the written confirmation of the quote. The dimensions, wood type, edge, finish and table legs recorded therein are decisive.
4. Prices
All prices are in Swiss francs (CHF) and include statutory VAT. The price shown at the time of ordering applies.
The choice of table legs, edge and finish from the standard variants offered is included in the price. Special requests are shown separately in the quote.
5. Delivery and assembly
We deliver throughout Switzerland. Delivery and assembly are free of charge.
The service comprises transport, carrying the table into the flat or house, assembling the legs, placing the table in the room and taking the packaging away. There are no further costs on site.
Tables from stock are normally delivered within 3 to 5 working days. Made-to-measure tables are usually produced within 4 to 6 weeks of order confirmation. We will call you before delivery to confirm the date and access.
Delivery times are estimates, not fixed dates, unless expressly agreed otherwise in writing. If we cannot meet an announced deadline, we will let you know as early as possible.
You must ensure that access to the installation location is clear and that the table will fit through doors, the stairwell or the lift. If delivery is not possible for reasons for which you are responsible, we may charge the cost of a second delivery attempt.
6. Payment
The payment methods shown during the order process are available. [confirm payment methods and any deposit]
For made-to-measure tables, 30% of the price is due on order confirmation; the balance falls due on delivery, once you have seen the assembled table.
The goods remain our property until payment has been made in full.
7. Returns
Swiss law provides no statutory right of withdrawal for online orders. We nevertheless voluntarily offer a 14-day right of return, from receipt, for stock tables in their original, unaltered form. Details and exceptions are set out in our Returns policy.
8. Liability for defects and warranty
The statutory provisions on liability for defects under Art. 197 et seq. CO apply. Please inspect the table on delivery and report any visible defects immediately, and within 7 days at the latest, in writing to [email protected]. Hidden defects must be reported as soon as they are discovered.
In addition, we offer a 2-year commercial warranty on construction and joints. The details are set out in our Warranty.
Solid wood moves: changes in the grain, fine cracks and slight movement of the tabletop caused by the indoor climate are natural properties of the material, not defects.
9. Liability
We are liable for damage we have caused intentionally or through gross negligence. Liability for slight negligence, indirect damage, consequential damage and lost profit is excluded to the extent permitted by law. Liability for personal injury remains unaffected in all cases.
10. Data protection
How we process personal data is set out in the Privacy Policy.
11. Changes to these Terms
We may amend these Terms at any time. The version published on the website at the time of the order applies to that order.
12. Applicable law and place of jurisdiction
Swiss law applies exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Walchwil (Canton of Zug), where the company has its registered office. This is without prejudice to mandatory places of jurisdiction for the protection of consumers.
